XPND provides corporate consultancy and business support services, including but not limited to:
- Strategic Advisory: Market entry strategy and feasibility studies.
- Company Incorporation: Establishment of PT PMA and PT Local entities.
- Immigration Services: Processing of Visas, Work Permits (RPTKA), and Stay Permits (KITAS).
- Business Process Outsourcing (BPO): Payroll, Tax, and HR administration.
While we strive to provide accurate and up-to-date information, XPND acts as a consultant and facilitator. The final approval of licenses, permits, and visas remains at the sole discretion of the relevant Indonesian government authorities.
2. USER RESPONSIBILITIES
By using our Services, you agree to:
- Provide accurate, current, and complete information as requested for the processing of your documents.
- Promptly notify us of any changes to your information (e.g., change of address, passport renewal).
- Use our Services only for lawful purposes and in accordance with Indonesian regulations.
- Pay all fees and government charges associated with the requested Services in a timely manner.
XPND reserves the right to suspend or terminate services if false or misleading information is provided.
3. INTELLECTUAL PROPERTY
The content on our Site, including text, graphics, logos, images, and software, is the property of PT Ekspansi Bisnis Indonesia and is protected by Indonesian copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without our express written permission.
4. PAYMENT TERMS & REFUND POLICY
- Fees: All professional fees and government costs will be outlined in a formal Quotation or Invoice.
- Payment: Payments must be made in the currency specified in the invoice within the due date stated.
- Refunds: Due to the nature of our services:
- Government Fees (such as PNBP for Visas or Notary fees) are strictly non-refundable once paid to the authorities or third parties.
- Service Fees may be refundable on a pro-rata basis only if the cancellation occurs before work has commenced, subject to XPND’s discretion. No refunds will be issued if a rejection is caused by the client’s ineligibility or provision of false data.
5. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, XPND shall not be liable for:
- Delays, rejections, or additional costs caused by changes in government regulations, system failures (e.g., OSS/Immigration system downtime), or decisions made by government officials.
- Any indirect, incidental, or consequential damages arising from your use of our Services.
- Loss of data or documents caused by third-party courier services.
Our total liability to you for any claim arising out of the Services shall not exceed the amount of the Professional Service Fees actually paid by you to XPND for the specific service in dispute.
6. CONFIDENTIALITY
We are committed to maintaining the confidentiality of your proprietary information. XPND will not disclose your sensitive business data or personal documents to third parties, except as required by law or necessary to perform the Services (e.g., submitting documents to the Ministry of Law and Human Rights).
7. THIRD-PARTY LINKS
Our Site may contain links to third-party websites (e.g., government portals). We are not responsible for the content or privacy practices of such external sites.
8. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in South Jakarta.
9. CHANGES TO TERMS
XPND reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site or Services constitutes your acceptance of the modified Terms.
